On June 24, 2019, the CFPB and the Federal Reserve Board jointly published amendments to Regulation CC that will adjust for inflation the amount of funds depository institutions must make available to accountholders. The compliance date for the adjusted amounts is July 1, 2020; however, certain technical amendments go into effect September 3, 2019. The Federal Reserve and Consumer Financial Protection Bureau (CFPB) in late June finalized amendments to Regulation CC to implement a statutory adjustment to adjust the dollar amounts under the Expedited Funds Availability (EFA) Act for inflation. The final rule is effective July 1, 2020. The dollar amounts will be adjusted every five years beginning July 1, 2020.

It seems like we’ve been waiting FOREVER for the funds availability sections of Regulation CC (Subpart B) to be updated. Well, on June 24, 2019, the CFPB and Federal Reserve finally issued a Final Rule.. While it’s not everything we were hoping for, it is a start. On Monday, June 24, 2019, the Consumer Financial Protection Bureau (CFPB) and Federal Reserve Board (FRB) finalized amendments to Regulation CC, which implements the Expedited Funds Availability Act of 1987 (EFA Act). The amendments institute a Dodd-Frank Act statutory requirement to adjust for inflation the amount of funds depository institutions must make available to their customers. The In addition, the final rule implements a provision of S. 2155 to extend coverage of Reg CC to American Samoa, the Northern Mariana Islands, and Guam. The final rule did not address the Fed’s 2011 proposal regarding funds availability under Reg CC, which was reopened for comment in November. Read the final rule.
